The short version
- The game is currently free and in early development — expect bugs and breaking changes.
- Play it, record and monetize videos of it. Just don't resell it, re-upload it as your own, or cheat online.
- Single-player needs no account. Multiplayer accounts can be banned for cheating or abuse.
1. Scope and provider
These terms govern the use of the website overcomingwilderness.com, the game Overcoming Wilderness including its launcher and installer (together the “Game”), and the optional online services (account system and multiplayer, together the “Services”). The provider is Kian Ansari (see Imprint). By downloading or playing the Game or using the Services, you agree to these terms.
2. Early development
The Game is in an early stage of development and is provided free of charge. Features may be incomplete, change significantly, or be removed; updates may alter or (in exceptional cases, such as breaking world-format changes) reset game worlds. There is no promise of specific features, of continued development, or of permanent availability of the Game or the Services.
3. License to play
The Game is proprietary software — © Kian Ansari, all rights reserved. You are granted a personal, non-exclusive, non-transferable, revocable license to download, install and play the Game for private, non-commercial purposes on your own devices. You may not:
- sell, rent out, sublicense or otherwise commercially exploit the Game or access to it;
- re-upload or redistribute the Game files (link to this website or the official releases instead);
- remove copyright or license notices;
- decompile or reverse-engineer the Game except where mandatory law (e.g. §§ 69d, 69e UrhG) permits it.
Third-party components contained in the Game remain under their own licenses — see Licenses. Nothing in these terms restricts the rights those licenses grant you (for example, replacing the bundled OpenAL Soft library).
4. Content creation — videos and streams
You are expressly welcome to create, publish and monetize videos, streams, screenshots and similar content featuring the Game (e.g. on YouTube or Twitch) — including its music and sounds as part of that content. This permission does not cover presenting the Game as your own work, offering the Game files themselves for download, or extracting and redistributing the Game's music, sounds or other assets as standalone files (e.g. as an album, sample pack or sound library).
5. Mods and private servers
The Game is designed to be modded; community mod support opens in the near future. Once it does, you may create and share mods, provided they do not contain substantial parts of the Game's own code or assets, do not circumvent security or anti-cheat measures, and do not contain malware. Mods are used at your own risk and are not officially supported. The same applies to self-hosted game servers once server hosting becomes available: private, non-commercial use is welcome; selling access to servers or in-game advantages is not permitted.
6. Accounts
Single-player requires no account. For online multiplayer you can create an OvercomingWilderness account. You must provide a working email address, keep your credentials confidential, and are responsible for activity on your account. One account per person; you must be at least 16 years old or have the consent of a parent or guardian. How account data is handled is described in the Privacy Policy.
7. Fair play and prohibited conduct
When using the Services you must not:
- cheat, exploit bugs to others' detriment, or use tools that manipulate the client, traffic or server (hacks, dupes, bots);
- disrupt or overload the Services (e.g. denial-of-service, flooding, probing for vulnerabilities);
- harass or threaten other players, or use unlawful, hateful names or content;
- impersonate other persons, or access accounts that are not yours.
Violations may lead to warnings, temporary suspension or permanent banning of your account and, in serious cases, exclusion from the Services altogether. Statutory rights remain unaffected; we may retain minimal records of enforced bans (see Privacy Policy).
8. Availability, changes and discontinuation
The Services are provided as a free, best-effort offering without any guaranteed uptime. Maintenance, updates or technical problems may interrupt them. We may modify or discontinue the Game or the Services; if the account service is permanently discontinued, we will give reasonable advance notice on this website where feasible. Local single-player play is not affected by a discontinuation of the online Services.
9. Warranty and liability
The Game and the Services are provided free of charge. Statutory rules for gratuitous services apply accordingly: we are liable without limitation for intent (Vorsatz) and gross negligence (grobe Fahrlässigkeit), for injury to life, body or health, and under mandatory statutory liability (e.g. fraudulent concealment of defects). Beyond that, liability for simple negligence is excluded. We do not warrant that the Game is free of defects or fit for any particular purpose. Back up data that matters to you — worlds and saves can be affected by updates (see section 2).
10. Changes to these terms
We may update these terms when the Game or the Services evolve (for example, when new online features launch). The current version is always available on this page with its revision date. If you continue to use the Services after a change takes effect, the updated terms apply; if you do not agree with a change, stop using the Services and — if you have an account — request its deletion.
11. Governing law
These terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer with habitual residence in another country, the mandatory consumer-protection provisions of that country remain unaffected. Should individual provisions of these terms be invalid, the remainder stays in force.
